24-Year-Old Worker Dies After Being Crushed by a Large Pipe at Saratoga Springs Construction Site

Date: May 17, 2013

A 24-year-old construction worker was recently crushed to death in upstate New York. According to authorities, a 1,700-pound pipe reportedly came loose and fell on the man while it was being moved off of a flatbed trailer at a construction site near Saratoga Springs. The 40-foot pipe allegedly fell approximately eight feet before it landed on him. Although emergency responders purportedly transported the man to a local hospital via ambulance, he was unfortunately pronounced dead when he arrived. The exact cause of the fatal workplace accident is currently being investigated by the New York State Police, the New York Public Service Commission, and the nation's Occupational Safety and Health Administration (OSHA).

Sadly, 4,609 people apparently died in workplace accidents in New York and across the country in 2011. Congress established OSHA in an effort to reduce or eliminate the number of serious or deadly workplace injuries suffered by employees throughout the nation. The Occupational Safety and Health Act of 1970 created OSHA and requires employers in the United States to comply with a number of federal health and safety requirements. In addition, employers are tasked with providing their workers with a workplace environment that is reasonably free of safety hazards. When a deadly workplace accident occurs, OSHA will normally investigate whether the construction or other accident site complied with federal safety regulations.

OSHA data claims more than 17 percent of fatal workplace accidents in the United States occur at construction sites. It is a tragic fact that individuals who are employed in the construction industry normally face treacherous working environments each and every day. The top four causes of construction worker deaths include being struck by an object, unexpected falls, electrocution, and being caught or crushed.

Most on-the-job injuries that occur in the State of New York are subject to workers' compensation laws. Still, in some situations a negligent third party like a general contractor may be held responsible for failing to comply with federal safety regulations.
